Your purchase, enrollment in and use of products, services and events ("Workshops") offered by Dino H Carter and/or Dino's Paws Brigade, including your access to dinospawsbrigade.com and its respective subdomains (the “Site(s)”), are subject to these terms and conditions (“Terms”). If You purchase or enroll in a Workshop for use by another (for example, a relative purchasing for a relative) these Terms govern both You and other(s) who use any Workshop you purchase (collectively, “You”). You agree to be bound by the Terms, which is an agreement between Dino H Carter and/or Dino's Paws Brigade and You.

As a participant of the Workshops, You consent to being recorded during the Workshop

Workshop Fees: You agree to make full payment for Workshops in the amount(s) listed in the Billing Page, or as communicated by Dino H Carter and/or Dino's Paws Brigade. You must complete payment prior to commencing the Workshop.

Refunds: Refunds are not available unless the Workshops were canceled. If the Workshops were recorded and receiving the Workshops' recording is part of the Workshops You will get the recording and any other material that is part of the Workshops, such as a cheatsheet. To inquire about a refund, please contact us directly.

Refund Policy: Upon your payment, all sales are considered final. By purchasing our products, You acknowledge that You have read, understood, and agreed to our non-refundable policy. Please review this policy prior to making any purchases.

Intellectual Property: All Workshops and Online Resource Courses, including Sites and Apps, are owned by Dino H Carter and/or Dino's Paws Brigade and its licensors. Workshops and Online Resource Courses are for your personal and non-commercial use only. You may not enroll in or use any Workshop or Online Resource Courses for the benefit of any competitor of Dino H Carter and/or Dino's Paws Brigade. Workshops and Online Resource Courses may not be shared, recorded by You, re-sold, reproduced, re-published, modified, transferred or distributed in any way without Dino H Carter and/or Dino's Paws Brigade’s prior written permission. All packets, video, audio, text, questions, explanations, diagrams, images, animations and other content that You receive or to which You have access during your Workshop and Online Resource Courses, regardless of medium or format, (collectively, “Workshop and Online Resource Courses Content”), are protected by copyright law and belong to Dino H Carter and/or Dino's Paws Brigade and its licensors.  You may not download, record, screenshot, copy or reproduce Workshop or Online Resource Courses Content in any way. You may not make any audio and/or video recording of a class or any part of your Workshop or Online Resource Course. You may not attempt to decompile, reverse engineer, scrape or datamine Workshops or Online Resource Courses. The trademarks, service marks, designs, and logos displayed in Workshops and Online Resource Courses are the registered and unregistered trademarks of Dino H Carter and/or Dino's Paws Brigade. Dino H Carter and/or Dino's Paws Brigade's licensors may not be used without Dino H Carter and/or Dino's Paws Brigade’s prior, written permission. 
Workshops may include digital access to Online Resource Courses. Subject to your compliance with these terms and conditions, Dino H Carter and/or Dino's Paws Brigade grants You a limited, personal, non-exclusive, revocable and non-transferable license to access and Online Resource Courses during the access period defined for that particular workshop. 
 

Because dogs are animals and may be unpredictable, Dino’s Paws Brigade and/or Dino Carter cannot protect against every potential injury, risk, or accident. This Release and Waiver are intended to shift the risk of participating in dog training to the Participant/Owner/Guardian of the dog participating in training.

Participants acknowledge that they have had a full opportunity to discuss any and all concerns they have regarding foregoing risks with Dino'S Paws Brigade and its authorized representatives.

 

Participant agrees to hold Dino Carter and Dino's Paws Brigade harmless from any and all claims of injury, loss, cost, expenses, or damage caused by the actions of Participant's dog during the course of training/boarding/walking, or under the care, custody or control of Dino. Participant hereby accept and assume, without reservation, all risks associated with my participation in the training program, including, but not limited to the risks of any and all injuries to themself, their dog, and any of their family members or third parties who may attend or be present in the area where training is taking place; the risks that their dog may cause injury to other persons and/or dogs involved; and the risks that saliva, water, food, and/or other debris may be present in the training area. Participant agrees to abide by Dino’s Paws Brigade's training Policies.

 

As lawful consideration for participating in the training program, Participant, for themself, thei heirs, next of kin, executors, administrators, legal representatives, successors and assigns (the “Releasing Party”), hereby waive, release, discharge and covenants not to sue and to indemnify, defend and hold harmless Dino Carter, "Dino's Paws Brigade" and their, agents, and employees (the “Released Party”) from any and all injuries, losses, claims and damages to any person or persons of any nature its directors, officers, employees, agents, sponsors, organizers, volunteers or other representatives, his successors and/or assigns, (hereinafter collectively the “Releases”) from any and all liability to the Undersigned for any loss, harm, damage, claim, injury, or accident to the person or property of the Undersigned, whether caused by any ordinary negligent act or omission of the Releases while the Undersigned or his/her dog is engaged in or participating in dog training/boarding/walking or using any Trainer or Business facilities in connection Therewith.

This Waiver of Liability & Informed Consent Release shall be legally binding on the Releasing Party. No waiver or modification of any provision herein shall be valid unless expressly agreed to in writing by both the Released Party and the Releasing Party.

 

Participant hereby consents to their dog and themself being the subject of the photographs and/or audiovisual recording and authorizes Dino Carter and Dino's Paws Brigade to be exhibited for educational purposes or marketing tools as still photographs, video, or other similar media.


YOU AGREE THAT Dino H Carter and/or Dino's Paws Brigade WILL NOT, UNDER ANY CIRCUMSTANCES, BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY GOODS, SERVICES, INFORMATION, RESOURCES AND/OR CONTENT AVAILABLE ON OR THROUGH ANY THIRD-PARTY SITES AND/OR THIRD-PARTY DEALINGS OR COMMUNICATIONS, OR FOR ANY HARM RELATED THERETO, OR FOR ANY DAMAGES OR LOSS CAUSED OR ALLEGED TO BE CAUSED BY OR IN CONNECTION WITH YOUR USE OR RELIANCE ON THE CONTENT OR BUSINESS PRACTICES OF ANY THIRD PARTY.

User Content: If You submit comments, photos and other content to us (“User Content”) through Workshops, Site(s), social media communities, survey responses, email or otherwise, You grant us an irrevocable, royalty-free, perpetual, transferable, license to use, modify, create derivative works from, publish, display and sublicense User Content, in whole or in part, in any format and on any platform either now known or hereinafter invented, and to associate User Content with your name and/or likeness. You are solely responsible for your User Content. You represent that You have the right to submit User Content to us and the right to grant us the license described above. You warrant that User Content, and our use thereof, does not and will not infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary or privacy right of any party or individual.


Mobile Devices: Workshops may offer Content and features that are available via a mobile device. Standard messaging, data and other fees may be charged by your carrier. Your carrier may prohibit or restrict certain mobile features and certain mobile features may be incompatible with your carrier or mobile device. Contact your carrier with questions regarding these issues.  

Class Schedule and Location Changes: Class schedules and locations of Workshops are subject to change and/or cancellation. Dino H Carter and/or Dino's Paws Brigade will notify You of any changes or cancellations. 


Participant Code of Conduct: Dino H Carter and/or Dino's Paws Brigade may remove from Workshops Participants whom Dino H Carter and/or Dino's Paws Brigade deems in its discretion to be disruptive to the learning environment, dangerous to other Participants or faculty, have failed to comply with a site’s health and safety policies, repeatedly violate policies such as classroom etiquette, have acted in a manner that shows lack of dignity and respect for instructors and/or Participants, have violated any intellectual property rights of Dino H Carter and/or Dino's Paws Brigade or others, or have engaged in academic misconduct, such as cheating or violating confidentiality.  Participants removed from Workshops for violations of the Code of Conduct are not eligible for refunds or eligible to purchase other Workshops.

Classroom Etiquette:  You must follow proper classroom behavior when participating in the Workshop and engaging with fellow Participants and faculty online or in-person, as applicable:

1. Do Not Record. You cannot take photos or videos of others, or the presentation, without permission. You cannot share or post pictures or videos of others without their knowledge or permission.

2. Be Professional. Dress with clothes appropriate for the Workshop. You are responsible for your screen name, computer screen and background displayed to others. You may not display any offensive or inappropriate material on your person or your screen.

3. Be Respectful and Kind. Ask appropriate questions, and be willing to listen/read to fellow Participants and their chat questions and engage in the learning process. Do not dominate other Participants' opportunity to learn by asking too many questions. When asking questions and making comments, keep them related to the discussion at hand. Do not abuse the chat box.

4. Be Prepared to Learn.  Arrive to the Workshop on time and come to the Workshop prepared. Refrain from checking any other websites (social media, gaming, etc.) or messages during a Workshop. 

5. Eliminate Distractions. Mute yourself unless you are called on to speak. Turn mobile phones off. Choose a location that will not cause distraction for you or others who will view your screen or hear your background noise during the Workshop. 
    

 
Arbitration and Class/Collective Action Waiver: 

You hereby expressly waive any and all claims you may have, now or in the future, arising out of or relating to the Workshops, this Website, the Company, any and all contracts you enter into with the Company, and any and all of the Dino H Carter and/or Dino's Paws Brigade's products and services.

To the extent that you attempt to assert any such claim, you hereby expressly agree to present such claim only through binding arbitration to occur in Los Angeles, California. You further agree to and do hereby waive any right to class arbitration and agree, instead, to conduct an arbitration related solely to any individual claims you and/or any entity related to You asserts against Dino H Carter and/or Dino's Paws Brigade. To the fullest extent permissible by law, you further agree that you shall be responsible for all costs associated with initiating the arbitration and for the administration of the arbitration.

Workshop sessions may be delivered through communications technologies including but not limited to Zoom, Google Classroom or Microsoft Teams or another meeting platform. By purchasing the Workshop(s), You certify that Dino H Carter and/or Dino's Paws Brigade and any third party technology vendor used to deliver the instruction, has consent to record any participation you choose to engage in during the sessions (i.e. chats, shared screen time initiated by you). The Workshop recordings may be made available to other Dino H Carter and/or Dino's Paws Brigade Participants for instruction, may be used internally for quality assurance and training to improve the Workshops, or for other internal purposes.

Miscellaneous:
These Terms supersede all prior oral or written agreements and constitute the entire agreement between the parties. Terms cannot be changed or modified orally. If any provision of Terms is found to be unenforceable for any reason, such provision shall be construed by limiting it to make it enforceable to the maximum extent permitted by law, and the remainder of Terms shall continue in full force and effect.
